General Terms and Conditions for the Use of the AJPES Web Portal

Based on point 1 of the fourth paragraph of Article 19 of the Decision on the establishment of AJPES (Official Journal of the RS, No. 53/02, 87/02 and 16/07), I accept the following:


General provisions

Article 1

These terms and conditions govern access to the web portal (hereinafter: the portal) of the Agency of the Republic of Slovenia for Public Legal Records and Related Services (hereinafter: AJPES), the use of information and documents (hereinafter: the data), the use of web services, and the responsibilities of AJPES and the users.

System access and use

Article 2

Portal users can be registered or unregistered.

The general terms and conditions shall be subject to and binding for all types of users who are using the portal.

Registration is free and one-time.

Upon registration, users are assigned a username binding the right to use the portal services.

Upon the first registration, the user must enter his/her e-mail address, which will later enable him/her to recover the password in order to access certain services that do not require any additional information (e.g. a qualified digital certificate or tax identification number in the case of the issue of an invoice). The user can enter the data required for the use of these services at the time of the registration or subsequently before the use of the service. The data is stored in the user profile, which can be altered via the "My Page" web page.

Registered users login into the portal with the username and password, which are non-transferable.

The user is responsible for all activities that are carried out under his/her username. Data collected in the user profile is only used for AJPES services and shall not be transferred to third parties.

Unregistered users can use free services and functionalities that do not require login into the portal and those payable services that can be paid for electronically without issuing an invoice. For unregistered users, the use of other services and functionalities of the portal is limited or disabled.

Limitation of liability

Article 3

AJPES provides the uninterrupted operation of portal services (24 x 7), except in the case of force majeure. Shorter disruption of access or suspension of the operation of the portal may occur – normally after 17 pm and on non-working days – for technical reasons (maintenance and / or replacement of equipment). Prior notification regarding longer interruptions shall be published on the portal main page.

AJPES also publishes information from other sources – systems (e.g. the network of the European Business Register), in accordance with the specific conditions and possibilities provided by these sources. The terms of use are set out in the description of the individual service on the AJPES portal.

Article 4

The information on the portal has legal consequences provided for by individual regulations that ensure their publication or explicit statement, otherwise they are merely informative.

AJPES reserves the right to change or modify the content of the portal at any time, in any way and for whatever reason without prior notice. AJPES assumes no responsibility for any consequences thereof.

Article 5

Portal users shall use the data from registers and other records in accordance with the regulations and conditions prescribed for the use of individual AJPES service.

AJPES is not responsible for the form, content and accuracy of the information obtained from business entities or from external information sources.

Article 6

Users shall use the portal at their own risk. AJPES shall not be liable for any damages that may arise due to incorrect access, improper use or the inability to use the data and web services on the portal. Users must provide their own measures to protect their IT equipment necessary for smooth and safe access to the data (i.e. protection against intrusion, protection against viruses and other malicious software, etc.).

Protection of intellectual property rights and the use of data

Article 7

The data in AJPES web services are part of the databases in the AJPES information system and as such are entirely or as individual parts of the system protected in accordance with the Copyright and Related Rights Act. The same protection also applies to the manner and scope of the databases from foreign sources – members of the EU or other states protected by national regulations or EU conventions.

Users of the portal data are obliged to respect the provisions of the Copyright and Related Rights Act governing the rights of database producers, the provisions of the Public Information Access Act and the provisions of the Decree on communication and re-use of information of public character governing the re-use of public information.

The user can simultaneously use only insignificant parts of databases (qualitative and / or quantitative) or to the extent estimated within the context of available web services provided that he/she indicates the corresponding data source: "Public Information of Slovenia - Agency of the Republic of Slovenia for Public Legal Records and Related Services."

All other forms of further transmission or enabling the use to third parties (e.g. publication on the user’s or a third party’s server, reproduction in other documents, etc.) is expressly prohibited. This prohibition applies to all types of use except for the user's own personal use. The following practices are strictly prohibited:
• The use of substantial parts (qualitative and / or quantitative) of the database content (e.g. the reproduction of database structure, parts of the database structure, the creation of public and private databases, etc.).
• The use of databases contrary to their normal use or in a manner that could harm the interests of AJPES (e.g. the systematic and repeated use of insignificant database parts, etc.).
• Gathering substantial parts (qualitative and / or quantitative) of databases by means of specific software solutions.
• Removal of the source references.

The prohibitions stipulated in the previous paragraph, except for the last indent, do not apply for the official announcements on the portal of Agency of the Republic of Slovenia for Public Legal Records and Related Services (AJPES). As regards the automated receipt of documents published in insolvency proceedings, please contact the Supreme Court of the Republic of Slovenia, Centre for Informatics or Sector for Project Management.

In the case of suspected abuse under this article and/or if the user's behaviour endangers the functioning of the portal, his/her access shall be restricted.

In terms of the Public Information Access Act, the request for the re-use of data from registers, which can be submitted directly via the portal and by making a payment, shall be regarded as an informal request.

Article 8

Removal or replacement of registered trademarks used by AJPES is strictly prohibited.

Article 9

Links to the portal or to the main page and/or to the individual subsites are allowed provided markings, signs or wording protected in accordance with the protection of copyright or related rights regulations, and other notices on individual website are not removed or hidden.

In the case of the abuse described in the previous paragraph, AJPES may require the removal of the links.

Article 10

In the event of a breach of these general terms and conditions the user will bear the responsibility for the misappropriation of data and any loss or damage resulting therefrom to AJPES.

Article 11

Any disputes arising from violations of these Terms and Conditions shall be settled amicably. However, if this is not possible disputes shall be settled by the court of competent jurisdiction in Ljubljana.

Final provision

Article 12

These terms and conditions shall enter into force on the day they are published on AJPES portal.
