General Terms and Conditions of Use of the AJPES Web Portal

Pursuant to Item 1 of the fourth paragraph of Article 19 of the Decision on the establishment of the Agency of the Republic of Slovenia for Public Legal Records and Related Services (Official Gazette of the Republic of Slovenia, No. 53/02, 87/02, and 16/07), I hereby adopt these

GENERAL TERMS AND CONDITIONS OF USE OF THE AJPES WEB PORTAL

General Provision

Article 1

These General Terms and Conditions govern the access to the web portal (hereinafter the Portal) of the Agency of the Republic of Slovenia for Public Legal Records and Related Services (hereinafter AJPES), the use of the data and documents (hereinafter: the Data), the use of web services, and the responsibilities of AJPES and the users.

System Access and use

Article 2

The General Terms and Conditions apply to and are binding for all types of users of the Portal.

Registration is one-time only and free of charge.

Upon registration, users are assigned a username with the attached rights to use the services of the Portal.

Upon first registration, users enter their email address, which later allows them to recover their password in order to access certain services that do not require any additional data (e.g. a qualified digital certificate or tax identification number in the case of invoicing). Users can enter the data required for the use of these services at the time of registration or subsequently before the use of the service. The data is stored in the user profile, which can be changed via the “My Page” web page.

Registered users log into the Portal with the username and password, which are non-transferable.

Users are responsible for all activities that are carried out under their username. AJPES uses the data collected in the user profile exclusively for AJPES services and shall not transmit it to third parties.

Unregistered users can use a part of the free services and functionalities that do not require logging into the Portal. The use of other services and functionalities of the Portal is limited for unregistered users.

Anonymous users are users who log in as anonymous and may browse websites that do not require login.

Limitation of Liability

Article 3

AJPES provides the uninterrupted operation of the services (24/7), except in the case of force majeure. Short interruptions in access or interruptions in the operations of the Portal may occur for technical reasons (for reasons of maintenance and/or equipment replacement), normally after 5 p.m. and on non-working days. The announcement of planned longer interruptions shall be published on the homepage of the Portal in advance.

As part of its services, AJPES also publishes information from other sources – systems (e.g. the European Business Register Network), in accordance with the special terms and conditions and the possibilities provided by these sources. The terms of use are set out in the description of the individual service on the AJPES Portal.

Article 4

The data on the Portal has legal consequences, if this is stipulated in the individual rules under which it is published or if this is explicitly stated; otherwise, the data is of purely informative nature.

AJPES reserves the right to amend and update the content of the Portal at any time, by any means and for whatever reason, without prior notice. AJPES assumes no responsibility for any consequences of such changes.

Article 5

Portal users shall use the data from the registers and other records in accordance with the rules and conditions laid down for the use of individual AJPES services.

AJPES assumes no responsibility for the format, content and accuracy of the data that it obtains from business entities or from external sources of information.

Article 6

Users use the Portal and the data at their own risk. AJPES assumes no responsibility for any damages caused to the users due to incorrect access, improper use or the inability to use the data and web services on the Portal. Users shall take all the measures that are necessary for the protection of their IT equipment and that are required for unhindered and safe access to data (e.g. anti-hacking protection, anti-virus protection, anti-malware protection, etc.).

Protection of Intellectual Property Rights and the Use of Data

Article 7

The data contained in AJPES web services is a part of the databases in the AJPES information system and as such is, entirely or as individual parts of the system, protected in accordance with the Copyright and Related Rights Act. The same protection also applies to the manner and scope of the use of databases from international sources – EU members and non-EU members, which are protected by national regulations or EU conventions.

Users of the Portal’s data shall comply with the provisions of the Copyright and Related Rights Act governing the rights of database producers, the provisions of the Public Information Access Act, and the provisions of the Decree on the provision and re-use of public information governing the re-use of public information.

Users may only use minor parts of the databases at a time (in terms of quality and/or quantity) or only to the extent foreseen in the context of the available web services, provided that the source of the data is duly indicated: “Public Information of Slovenia – Agency of the Republic of Slovenia for Public Legal Records and Related Services”.

All other forms of further transmission or the enabling of use to third parties (e.g. publication on the users’ server or a third-party server, reproduction in other documents, etc.) are explicitly prohibited. This prohibition applies to all types of use, except the users’ personal use. In particular, the following practices are strictly prohibited:
• The use of substantial parts (in terms of quality and/or quantity) of databases (e.g. the reproduction of database structure, parts of the database structure, the creation of public and private databases, etc.)
• The use of databases contrary to their normal use or in a manner that could harm the interests of AJPES (e.g. the systematic and repeated use of minor parts of databases, etc.)
• Capturing substantial parts (in terms of quality and/or quantity) of databases by means of specific software solutions
• Removal of source references

With the exception of the last indent, the prohibitions stipulated in the preceding paragraph do not apply to the official publications on the AJPES Portal. For the automated acceptance of documents published in insolvency proceedings, please contact the Supreme Court of the Republic of Slovenia, the Centre for Informatics or the Project Management Service.

In the case of suspected abuse under this article and/or if the users’ behaviour endangers the functioning of the portal, AJPES may restrict such users’ access.

The request for the re-use of data from registers, which users can submit directly via the Portal and by making a payment, shall be regarded as an informal request within the meaning of the Public Information Access Act.

Article 8

The removal or replacement of registered trademarks used by AJPES is strictly prohibited.

Article 9

Links to the Portal or to the homepage and/or to the individual websites are allowed provided that the tags, signs or records protected in accordance with the rules governing the protection of copyright and related rights, and other notices on an individual website are not removed or hidden.

In the event of abuse referred to in the preceding paragraph, AJPES may request that the link be removed.

Article 10

In the event of a violation of these General Terms and Conditions, the users shall be liable for the unauthorised acquisition of data and any damage resulting therefrom caused to AJPES.

Article 11

Potential disputes arising from the violation of these General Terms and Conditions shall be settled amicably. If this is not possible, the disputes shall be settled by the competent court in Ljubljana.

Article 12

AJPES reserves the right to amend and update these General Terms and Conditions.

Conditions for the Provision of Test Services

Article 13

AJPES shall occasionally offer users the possibility of test services in which it shall ask the users for feedback on user acceptance in exchange for the possibility to test a new service. Information on user acceptance shall be obtained by AJPES by sending an email to the users’ email address and by calling the users by phone and conducting a short interview.

Article 14

By joining the test service, the users undertake to allow the use of their email address and telephone number for the purposes of interviewing or obtaining feedback on user experience in return for the testing of the service. In this case, the acceptance of the General Terms and Conditions also has the effect of consenting to the processing of the users’ personal data in accordance with the provisions of the act governing electronic communications.

Final Provision

Article 15

These General Terms and Conditions shall enter into force on the day they are published on the AJPES Portal.
